By participating in AIA’s “I Say YES” Campaign (hereinafter the “Campaign”), participants shall be deemed to have read, understood and agreed to the following Terms and Conditions:
CAMPAIGN PERIOD
The Period of the Campaign shall be from 24th December 2023 to 31st December 2023 (hereinafter the “Campaign Period”).
STEPS TO PARTICIPATE
- To participate the Campaign, click the link (https://www.aia.com.mm/en/campaigns/I-Say-YES-Campaign.html), then post on Facebook on your timeline a photo of yourself embracing an activity that helps shape a Better You in 2024.
- Use “public” setting and the hashtags #ISayYES #AIAMyanmar #HealthierLongerBetterLives.
- Write your commitment in the caption (hereinafter the “Post”), for example "I Say YES to exercising regularly every morning."
- Share a screenshot of your Post and share it in the comment session under AIA’s original campaign announcement post.
WINNER SELECTION AND NOTIFICATION
- Three (3) winners will be chosen at random from amongst the participants by AIA at the end of the Campaign Period (each a “Winner” and collectively “Winners”) and will each receive an Apple Watch Series 9. Winners will be notified by AIA via Facebook within two (2) weeks following the end of the Campaign Period (hereinafter the "Winner Notification").
- The winner announcement will also be made in the comment section of the original campaign post by AIA. Additionally, a notification will be placed under the winner's comment. In the event that the winner has not responded within one (1) week, further notifications will be sent on the Post on their timeline.
- If a Winner cannot be contacted, or if the Winner fails to respond to AIA’s Winner Notification within thirty (30) days from the date on which the Winner Notification was sent by AIA, the Winner shall be deemed to have waived their winner status, and shall thereafter lose the right to claim the prize from AIA. AIA shall not be liable for any event (not being due to a wilful act or omission by AIA) which results in failure to receive a Winner Notification from AIA, or which results in the Winner being unable to respond to AIA within the given timeframe (including, but not limited to, technical difficulties, the Winner’s Facebook account being temporarily suspended, or Internet Services not being available at the winner’s location).
- Receipt by a Winner of the prize offered in this Campaign is conditioned upon the Winner’s compliance with any and all applicable laws and regulations of the Republic of the Union of Myanmar as well as these Terms and Conditions. Any violation of any applicable laws and/or regulations, or these Terms and Conditions by the Winner will (at AIA’s sole discretion) result in the Winner’s disqualification as a winner in the Campaign, and all their privileges as a winner will immediately be terminated.
- Any decision made by AIA with regards to the selection of a winner shall not be subject to challenge.
- Prizes are not exchangeable and cannot be redeemed for monetary value or for any other form of compensation. If for any reason, the designated prize cannot be awarded to the Winner, AIA retains the right to substitute an alternative prize of equal value as a replacement.
ADDITIONAL TERMS AND CONDITIONS
- By submitting a Post, you agree to allow AIA to use the content and pictures contained in your Post for marketing, promotion, information and education purposes, at no cost. AIA reserves the right to publicize and promote the Posts (and any content contained therein) for their own purposes. The winning Post submissions may be branded with the AIA logo at the discretion of AIA.
- Notwithstanding anything contained in paragraph no. (1) of this Section, AIA does not assume responsibility or liability for the content of the Post, or for any claims, damages, or losses resulting from the use or dissemination of any Post submitted in connection to this Campaign.
- All liability of AIA, or its officers, employees, directors, agents, advisers and/or contractors for any loss, damage, claim or expense (including but not limited to indirect, incidental, special, punitive or consequential liability, economic loss, loss of profits and loss of opportunity) participants may incur or suffer that arises directly or indirectly out of these Terms and Conditions, or the Campaign (regardless of whether AIA has any control over circumstances giving rise to the claim or not) including the termination or suspension of the Campaign, is hereby excluded to the maximum extent permitted by law.
- AIA reserves the right at all times to discontinue the Campaign or amend, add, or modify these Terms and Conditions without giving any prior notice. AIA’s decision in connection to these Terms and Conditions or any rules, regulations, policies, or procedures related to this Campaign shall be final.
- If any provision in these terms and conditions becomes unlawful, void, or unenforceable, the provision shall, to the extent required, be severed from these terms and conditions and rendered ineffective as far as possible without modifying the remaining provisions and shall not in any way affect any other circumstances of or the validity or enforcement of these terms and conditions.
- If there is a discrepancy between these Terms & Conditions and those in any promotional material, these Terms & Conditions will prevail.
- These Terms & Conditions are governed by the laws of The Republic of the Union of Myanmar. The interpretation and application of these Terms and Conditions shall be subject to the discretion of the Promoter and the decision of the Promoter in connection with these Terms and Conditions or any rules, regulations, policies, or procedures related to this Promotion shall be final.
