  • “Then Vs Now” Campaign Terms and Conditions

    By participating in AIA’s “Then Vs Now” Campaign (hereinafter, the “Campaign”), participants shall be deemed to have read, understood and agreed to the following Terms and Conditions.

    CAMPAIGN PERIOD

    The Period of the Campaign shall be from 1 September to 14 September, 2023 (hereinafter, the “Campaign Period”). 

    HOW TO PARTICIPATE 

    1. To participate in the Campaign, the audience are required to post two (2) photos of themselves on their Facebook account with public setting during the Campaign Period. The photos should demonstrate or showcase changes in the participant’s life journey (i.e., reaching a career goal, accomplishment of a personal milestone, achieving a financial goal or target, etc). In essence one of the photos should show the participant’s life in the past and the other photo showing an “evolution” or “change” in line with the mentioned life journey points. A brief description is needed to accompany the post highlighting the change from Then Vs Now. The description should include the following hashtags #AIAUniversalLife #AIAMyanmar #ThenVsNow at the end

    2. Once the post has been shared on the participant’s timeline, the participant must comment a screenshot of their post under the original campaign announcement on AIA Myanmar Facebook page (for the purpose of these Terms and Conditions, each screenshot posted shall be referred to as an “entry”)

    3. Each participant shall only be permitted one entry for this Campaign. Where a participant has sent multiple entries (whether from the same account or from multiple accounts), only one entry will be counted for said participant when selecting a winner

    WINNER SELECTION AND NOTIFICATION

    1. Four (4) winners will be chosen at random from among the participants by AIA at the end of the Campaign Period. Winners will receive iPhone 14 Pro Max (1 Unit) or Apple Watch (1 of 3 Units). Winners will receive a notification via Facebook Messenger (a “Winner Notification”) within two (2) weeks following the end of the Campaign Period.

    2. If a winner cannot be contacted, or if the winner fails to respond to AIA’s Winner Notification within seven (7) days, the prize will be forfeited, and AIA shall be entitled to select an alternate winner. AIA shall not be liable for any event (not being due to a wilful act or omission by AIA) which results in a participant’s failure to receive the Winner Notification from AIA, or which results in the winner being unable to respond to AIA within the given timeframe (including, but not limited to, technical difficulties, the winner’s Facebook account being temporarily suspended, or Internet Services not being available at the winner’s location).

    3. Receipt by a winner of the prize offered in this Campaign is conditioned upon the winner’s compliance with any and all applicable laws and regulations of the Republic of the Union of Myanmar as well as these Terms and Conditions. Any violation of any applicable laws and/or regulations, or these Terms and Conditions by the winner will (at AIA’s sole discretion) result in the winner’s disqualification as a winner in the Campaign, and all their privileges as a winner will immediately be terminated. 

    4. Any decision made by AIA with regards to the selection of a winner shall not be subject to challenge.

    5. Prizes are not exchangeable and cannot be redeemed for monetary value or for any other form of compensation.
       

    ADDITIONAL TERMS AND CONDITIONS

    1. By submitting a screenshot of their posts, participants agree to allow AIA, their affiliates and any of their promotional partners and/or sponsors (if applicable) to use their posts (and all contents contained therein) for marketing, promotion, information and education purposes at no cost. AIA reserves the right to publicize and promote the posts (and all contents contained therein) for their own purposes. The winning posts may be branded with the AIA logo at the discretion of AIA.

    2. Notwithstanding anything contained in paragraph (1) of these Additional Terms and Conditions, AIA does not assume any responsibility or liability for the content of the posts or screenshots thereof, or for any claims, damages, or losses resulting from the use or dissemination of any posts or screenshots submitted in connection to this Campaign.

    3. Participants shall be solely responsible to ensure that their posts or screenshots do not contain any content or material which constitutes a violation of the existing laws, or an infringement of any third-party intellectual property rights. Participants shall be liable to indemnify AIA against all claims, damages or losses resulting from such violations and/or infringements.

    4. All liability of AIA, or its officers, employees, directors, agents, advisers and/or contractors for any loss, damage, claim or expense (including but not limited to indirect, incidental, special, punitive or consequential liability, economic loss, loss of profits and loss of opportunity) participants may incur or suffer that arises directly or indirectly out of these Terms and Conditions, or the Campaign (regardless of whether AIA has any control over circumstances giving rise to the claim or not) including the termination or suspension of the Campaign, is hereby excluded to the maximum extent permitted by law.

    5. AIA reserves the right at all times to discontinue the Campaign or amend, add, or modify these Terms and Conditions without giving any prior notice. AIA’s decision in connection to these Terms and Conditions or any rules, regulations, policies, or procedures related to this Campaign shall be final.

    6. If any provision in these terms and conditions becomes unlawful, void, or unenforceable, the provision shall, to the extent required, be severed from these terms and conditions and rendered ineffective as far as possible without modifying the remaining provisions and shall not in any way affect any other circumstances of or the validity or enforcement of these terms and conditions.

    7. If there is a discrepancy between these Terms & Conditions and those in any promotional material, these Terms & Conditions will prevail.

    8. These Terms & Conditions are governed by the laws of The Republic of the Union of Myanmar. The interpretation and application of these Terms and Conditions shall be subject to the discretion of the AIA and the decision of the AIA in connection with these Terms and Conditions or any rules, regulations, policies, or procedures related to this Campaign shall be final.
